No stranger to frivolous lawsuits, Taylor Swift is being sued by Lucky 13 fashion retailer for allegedly using their name to increase her sex appeal. That’s the case being presented by owner Robert Kloetzly, whose lawyers are hoping to speak to Swift on “why she started selling t-shirts bearing the words Lucky 13.” You see, the number 13 is important to the “Bad Blood” singer because, “I was born on the 13th. I turned 13 on Friday the 13th. My first album went gold in 13 weeks. My first #1 song had a 13-second intro. Every time I’ve won an award I’ve been seated in either the 13th seat, the 13th row, the 13th section or row M, which is the 13th letter.”
That all seems perfectly normal.
Lucky 13 appeared on Swift merchandise ranging from including cards to shirts, and now Kloetzly is pestering her with “hundreds of discovery requests, including a bizarre demand for any promotional videos or photos that show glimpses of her ‘partially visible’ breasts or bottom.” (Via the Daily Mail):
Kloetzly’s lawyers are expected to argue that the risqué images constitute evidence in the case because they demonstrate how the 25-year-old musician uses her sex appeal to target a similar audience to his products.
Swift’s team of high-priced lawyers claim that she’s being harassed by the plaintiff, who “served a final set of written discovery on defendants that requested irrelevant material such as… all photographs and videos of you in which your breasts are at least partially visible, as well as documents reflecting, evidencing, or revealing who took each such photograph and video and where and when.” They’ve even asked a judge to step in to protect Swift from further “prejudice.”
Lucky 13’s attorney, Gary J. Rinkerman, dismissed Swift’s accusations of harassment as “typical legal rhetoric” that people deploy to try to avoid handing over material that could damage their case.
I didn’t realize Gary J. Rinkerman was Diplo’s real name. Anyway, the parties will go to trial in November, though Swift will not attend. It’s the one thing she won’t stick her nose into.
